在理性与权利之间——对国家与自由关系的一种解读

从第二次世界大战结束以来在政治法律领域中出现了一种现象:国家的公权力和公民个人的私权利从各自的维度上都得到了相当程度的扩张。而这种“双赢”的局面是以社会契约理论为基础的古典自由主义所无法解释的,然而对这一看似矛盾的问题的解释,我们依然只能从自由主义理念内核与发展历程中去寻找答案。本文就是笔者在这个方面做出的一些尝试。

Between Reason and Rights——An Explanation of the Relations of the State and Freedom

It appeared in the politics and law fields, since the World War II ,that the public power of the state and the private rights of the citizens gained expansion from their respective dimensions. The classic liberalism, based on the social contract theory, could not give us a satisfied explanation on the paradox, for which we can only still search the key from the soul of Liberalism. This paper is a try in the direction made by the writer.
