| 摘 要： | 高校与学生之间的关系已被纳入特殊权力的理论和实践范畴。目前国内一些高校对学生取得相应学位都有相关的规定,如一些高校规定学生在取得相应学位之前必须取得一定的外语和其他一些测试证明。以下将以特殊权力理论为支撑,对高校对学生的日常管理和自主管理权限的使用范围作出划分;同时探讨作为相对方的学生,如何采取合法的救济途径维护自身权利。

| Abstract: | The relationships between colleges and students have been included in the areas of theory and practice.At present,some university force students to obtain degree before English level and other formal test finished.Daily management and self-management is divided based on the theory of special powers.How to take relief ways to guard students＇ legitimate rights is also discussed. |
