| 摘 要： | 招收学生徇私舞弊现象在实践中已是司空见惯,一般人多是从道德视角对其进行评价,无论刑法理论还是司法实践在该问题上存在缺位现象。本文对招收学生徇私舞罪的犯罪构成进行较为详细的论述,尤其对其中一些模糊认识予以廓清,期望对本罪的认定有所帮助。

| Abstract: | Malpractice in recruiting students is very common, which is mostly judged trom moral perspective, not from criminal theory or judicial practice. This paper has made a study of the constitution of criminal case of malpractice in recruiting students, especially clarified some dim understandings, with a help to identify the crime. |
