校外人员进校体育锻炼意外伤害的责任分析与建议

由于我国应用于群众体育的体育场馆设施严重不足，国家鼓励机关、学校等单位内部的文化体育设施向公众开放。在这样的背景下，大量的校外人员涌进学校，利用学校的体育场馆设施参加体育锻炼。体育是有风险的，发生意外伤害在所难免。本文在查阅了大量的校外人员进校参加体育锻炼意外伤害案例的基础上，具体区分为学校责任、受害人自己的责任和第三人责任并进行相应的理论分析，进而提出解决此类纠纷的建议。

Analysis and Suggestions about the Responsibility of the Accidents of Social Mass Doing Physical Exercises in Uni- versities

Due to the serious shortage of sports facilities for the mass in China, the government encourages the sports facilities of governmental organs and universities to be opened to the public. In this context, the social mass flood into universities, using uni-versity sports facilities to take part in physical exercises. Sports is risky, and accidents are inevitable. Based on consulting a lot of injury cases about the mass who doing physical exercises in universities, this paper distinguishes among the responsibilities of universities, the victims themselves and the third party, makes a corresponding theoretical analysis and further puts forward suggestions to solve these disputes.
