| 摘 要： | 在我国，法人机关与法人的关系原则上是一体的。文章通过案例的引入，分析了对法定代表人诽谤的认定和对受害人的救济。认为对法定代表人的诽谤，既可以构成对法定代表人个人的诽谤，也可以构成对法人的诽谤；对法人的诽谤成立后，法人可以以自己的名义起诉。

| Abstract: | In china,the relation between judicial person's organization and this person is integrative.With case study,the paper analyzed cognizance and relief to the slander on the legal representative.It is believed that the slander is considered both toward the person and his organization,so if the slander is considered as real,the judicial person has the right to sue on behalf of personal slander. |
