| 摘 要： | 新刑法对正当防卫制度作了重大修改。分析新刑法确立的正当防卫制度的内容和特色，具有重要意义。从正当防卫制度的历史发展、性质、立法意图及我国社会治安现状等方面来看，新刑法第二十条第三款规定的是特殊防卫权而不是无限当防卫或无限防卫权
