| 摘 要： | 医疗事故的处理与法律政策的考量有密切关系。在医疗事故的处理中渗透着法律政策的因素，具体而言，法律政策对医疗事故中过失判断和举证责任倒置的设置具有重要的作用和影响，是医疗注意义务的来源之一，推动了举证责任倒置的设置。

| Abstract: | The treatment of medical accident is closely related to the considerations of legal policy. The legal policy factors run through the course of medical treatment. Specifically, legal policy plays an important role on medium - fault medical malpractice judgments and the burden of proof settings, which is one of the sources of obligations, and promotes the burden of proof settings. |
