试论国民待遇与对外资的优惠

加入世界贸易组织后,中国的外资立法逐步与WTO规则接轨。但对于国民待遇问题,理论界一直存在争议,国民待遇与对外资的优惠是否相悖是问题的焦点。“超国民待遇合法合理论”于法无据,于理相悖,要想吸引高质量的外资,必须依靠良好的投资法律环境。在现阶段,我国应以国民待遇原则为指导,逐步消除超国民待遇,从而确保内、外资企业在同一市场规则下公平竞争。

On the National Treatment and Foreign- fund Preference

After entering into WTO,China's law for foreign-fund investment gradually integrates with WTO rules.National treatment is being argued if the national treatment is contrary to the foreign fund investment.The legal and rational theory of the "super-national treatment is not based on laws and contrary to rationality.At present,China should gradually eliminate the super-national treatment by the guidance of the national principles so as to assure the domestic and foreign-fund enterprisers to have fair competition in the same market.
