也谈婚姻法司法解释（二）第二十四条的不足与完善

认定夫妻一方债务是否为夫妻共同债务，目前主要的法律依据就是最高人民法院关于适用《中华人民共和国婚姻：锄若干问题的解释（二）第二十四条的规定。但是该规定单纯以债务形成时间是否形成于婚姻关系存续期间为依据，形成了将夫妻一方债务认定为夫妻共同债务的一般性推定规则，在理论、立法和实务上均显不足，因此，该条规定有待于进一步的完善。
