| 摘 要： | 对于过失引起纯粹经济损失的赔付是理论界及实务界中面临的共同难题。通过上百年的发展，英美法、德国法在这个问题上已建立了各具特色的的责任排除规则，但英美法和德国法又分别采取过失侵权行为类型化和纯粹经济损失“权力化”对责任排除规则进行突破。我国侵权行为法应采取一般条款及类型化的方式解决这一问题。

| Abstract: | The amends to pure economic loss caused by negligence is a common difficult problem in theoretical and practice fields in the world. Through the development of centuries, British-American and German laws have established distinctive exclusionary rules of liabilities. But categorization of tort of negligence and entitlement of pure economic loss are adopted in these countries to break the rules. Chinese tort law should adopt the ways of and categorization of law terms to solve the problem. |
