我国雇用人责任制度的立法尝试

雇用人责任是大陆法系的一项法律制度，英美法系称之为替代责任。随着时代的发展，两大法系中构成该项法律制度基础的雇用关系突破了固有含义的限制，雇用关系发展为事实上的使用关系。雇用人责任在我国现有法律体系中尚属空白，我国已经具备了建立该项法律制度的社会基础，虽然我国已有该项法律制度的一系列立法尝试，但尚不足以解决社会生活中的现实问题.
