对我国结婚程序的立法思考

我国现行结婚登记制度存在不足。欠缺形式要件的事实婚姻长期大量存在，使得我国在司法解释法上、实践中及现行立法中，对其效力的认定一直持谨慎甚至妥协的态度，这是对结婚登记制的挑战。借鉴外国婚姻家庭法的可取之处，完善我国结婚程序，立法上宜采用结婚登记或仪式公告制，以及上门服务制。

Legislative Reflection on the Marriage Procedure in our Country

There are many shortcomings in the marriage registration system in China. Confronting so many informal marriages which lack registration , we have to be very careful or compromised when we are to judge the validity of these marriages in judicial explanation, practice and present legislation. So it's imperative to use the preferable experience of alien marriage and family laws in order to perfect Chinese marriage procedure. And we should employ both marriage registration system and marriage ceremony announcement system, even offer direct public marital services.
