| 摘 要： | 随着基因技术的日益进步,个人的基因隐私不断地被侵犯.上世纪90年代在我国发生的一系列人类基因资源被窃事件,不仅导致我国人类基因资源的大量流失,而且严重侵犯了我国人民的基因隐私利益.当代民法应明确用基因隐私权的权利形式保护基因隐私,并结合我国的国情,突破人格权专属性太强,难以与主体分离的传统理论,由法律直接授权权利人转让或许可他人使用其基因隐私的权利.

| Abstract: | With the development of gene-tech,the genetic privacy has being infringed.That a series of incidents had taken place in 1990s in our country of our human gene resources having been defrauded not only leads to many human gene resources running off,but also infringes the people's genetic privacy seriously.So the civil law should stipulate the genetic privacy right and authorize people to transfer or to permit the others to use his genetic privacy. |
