法经济学分析与经济法关系简析

法经济学分析是一门新兴的交叉学科,有学者认为这是经济学思维方式的一次扩张,也是法学家视角的一次转移,使得法学和经济学有了更为密切的联系。同时,经济学在经济法的整个发展过程中,一直也起着重要的作用。从学科的角度,法经济学与经济法学相距甚远,然二者亦有共通之处。本文即通过分析两者的特质,在界定两者关系的基础上,找到了二者的暗合之处——效益价值。

The relation between economic analysis of law and economic law

Economic analysis of law is a new developing inter-discipline, some scholars think it is an expansion of the thinking mode of economics and it makes law and economics have a more close relation. Meanwhile, economics has been playing an important role in the course of the whole development of economic law. Economic analysis of law is different from the science of economic laws in terms of disciplines, but they have something in common. This paper analyzes their characteristics and establishes their homology on the basis of their relation - benefit value.
