| 摘 要： | 公众参与既是环境保护的基础,也是现代民主社会的基本要求。基于此,许多国家制定的环境基本法、环境法典或其他综合性环境法规定了公众参与的实体和程序性权利。我国现行《环境保护法》有关公众参与规定不足,为此,在起草我国环境基本法关于公众参与的法律规范时,应树立环境法治和公民民主与科学参与的思想,要把公众参与和宪法中的人权保护和环境保护规范结合起来,并在其指导下把公众参与作为环境法的基本原则。

| Abstract: | Public participation is the base of environmental protection.And it is also the basic demand of modern democratic society.So basic environmental laws,environmental code or other integrated environmental law enacted by many countries prescribe the basic substance and procedure rights of public participation.In this paper,the author expounds the regulations firstly about public participation included in environmental laws,environmental code or other integrated environmental law enacted by main countries in the world such as America,France,Japan and Russia.Then the author summarizes the experiment about these legal regulations.Based on these works,shortcomings and its reasons about P.R.China Act on Environmental Protection are discussed.Lastly the author sets forth legislative suggestions on how to resolve these problems relied on the appeal of constituting China's environmental law. |
