| 摘 要： | 通过考察宪法修正案对非公有制经济历经由承认、保护到鼓励、支持和引导,进而指出负有保护非公有制经济权益使命和责任的刑法应服从宪法并体现其精神;应给予其与公有制经济对等的保护,这既是非公有制经济作为市场主体应有的权利,也是其宪法权利的实现。

| Abstract: | The Constitution has been amended about the nonpublic ownership: from protection to encouragement;from support to guidance.The amendment even holds that the criminal laws with responsibility to protect non-public ownership should conform with the Constitution and reflect its spirits.Non-public ownership should be protected as the public ownership.As subjectivity of the market,non-public ownership is entitled to the right prescribed in the Constitution. |
