| 摘 要： | 随着知识经济的发展,商标权与其他标识性知识产权的权利冲突日益明显。我国立法关于如何解决此权利冲突的规定存在着许多不完善之处,亟待改进。运用对比、引用及举例等方法,对商标权与其他标识性知识产权权利冲突的表现形式进行剖析,探讨解决这类权利冲突应遵循的基本原则,并针对我国的立法现状,提出避免和防范商标权与其他标识性知识产权权利冲突的一些设想及立法动议。

| Abstract: | With the development of intellectual economy,the rights conflict between trade mark and other marked intellectual property rights become more and more obvious.There are so many faultinesses in our legislation on how to resolve such rights conflict.Our legislation needs to be improved.With the methods of contrast,excerpt and examplification,this thesis analyses the manifestation of conflict between the trade mark right and other marked intellectual property rights,and discusses the basic principles of resolving such rights conflict,putting forward some assumptions and lawmaking move to avoid and keep away such rights conflict with a consideration of China's legislative situation. |
