| 摘 要： | 刑法中的正当防卫，是与不法侵害行为作斗争的正当合法行为；是法律赋予公民的一项权利；是对不法侵害者的不明显超过必要限度的损害。正当防卫要件的科学设立是防卫行为获得社会认同并取得正当性的前提。其要件包含起因要件、对象要件、主观要件、限度要件等五个方面。

| Abstract: | Justifiable defense in criminal law is the just and legal behaviour that struggles with unlawfulinfringement. It is citizens' right that is endowed by the law. The scientific establishment ofjustifiable defense behavior's important condition is the premise of justice which is identified bythe society. Its important condition includes reason, time, object, subject and limit. |
