| 摘 要： | 1989年通过的联合国《儿童权利公约》确立了＂儿童最大利益原则＂。在这个原则的指导下,关注儿童的最大利益成为收养立法的国际趋势。然而,我国的收养立法并未很好地体现这一原则,并且收养立法中还存在许多不足。这主要表现在：有必要放宽对收养人和被收养人的条件;没有试养期及不完全收养等对养子女有益的规定;当收养关系面临危险时,没有很好的保护到养子女的利益。

| Abstract: | Ever since the Principle of maximizing children’s interests was established by the United Nations Convention on the Rights of the Child in 1989,it has become an international norm to rule the adoption legislation.However,this is not the case in China,and problems are still many,just to name a few: 1) Requirements are too rigid;2) There are no regulations regarding such affairs as the trial period and partial adoption;3) the adopted child is vulnerable to risks once the adoption relationship is undermined. |
