浅论民族自决权--兼评"台湾法理独立"之非法性

民族自决作为国际法基本原则之一,对于反对殖民主义、促进民族解放运动的发展有极其重要的战略意义。在殖民体系瓦解的今天,民族自决原则受到了一定限制,尤其对于对外自决权的行使,只限于处于外国殖民统治、外国占领和外国奴役下的民族。我国台湾地区民族分裂分子妄图通过所谓“宪政改造”实现“台湾法理独立”,改变大陆和台湾同属于一个中国的现状,把台湾从中国分割出去。以所谓“宪法”和“法律”的形式实现其“台独”主张,其法理依据就源于民族自决权,但台湾根本不具备行使民族自决权的基本条件。

On National Self-determination--Taking into the Consideration of Illicit of Independence by Legal Theory of Taiwan

As one of the basic principle of the international law,national self-determination has been strategically important in opposing colonialism and promoting national liberation movement.After the crumble of the colonial system,the exercises of national self-determination principle has been certain limited. Especially only the nationality who is in the foreign country colonial rule can exercise the right of external self-determination. The racial segregation members in Taiwan attempt to realize "Taiwan independence by legal theory"by "constitution transformation",and then change the present situation that the Taiwan is a part of China.The legal theory which the racial segregation members in Taiwan use to separate our motherland is the right of external self-determination.But the area of Taiwan has no basic condition to exercise the right of self-determination.
