摘    要:我国《消费者权益保护法》第49条规定,其目的除惩罚和制止不法行为外,还有就是鼓励消费者同欺诈行为作斗争。欺诈以是否足以误导一般消费者为成立要件,并不要求有实际损害结果,也不必考虑行为人主观上的过错问题。即使“知假买假”,经营者也构成欺诈,消费者也应受法律保护。同时,为了对欺诈行为形成有效制约,惩罚性赔偿的数额标准应有一定的灵活性。

Abstract:The 49 item in the Law of Protecting the Consumer’s Right and Interests said, besides punishing and refraining the illegal conducts, another purpose of the law is to encourage the consumers to fight with the cheating conducts. The necessary condition is to mislead the genenal consumers, the real destroy result is not required, the subjective fault of the party is not necessary to be considered. The people who knew it’s artificial still buys it, which also belongs to the cheating conducts. Meanwhile, in order to restrain the cheating conducts, the figure standard should be flexible for the punishing compensation.
