| 摘 要： | 政府采购是政府实施自身职能为民众谋福利的一种行为，政府采购立法作为对其行为的规制在法律和制度层面意义重大。此类立法本身饱受部门性、单一性等内部性之困扰，使采购立法圄于困境；或可从立法收权、全程监控出发寻找有效的化解路径，从法规制定和制度执行层面克服政府采购立法的问题。

| Abstract: | Government procurement is a kind of government behavior that contributes to the welfare of the people. To systematically regulate government procurement as a norm to its behavior standard at the law level is of great significance.However,the department of implementation has suffered from some internal troubles.The centralization of the legislation and the supervision of the whole process should be a possible solution. |
