过度医疗侵权责任之研判

现代医学飞速发展,高端、前卫的诊疗技术手段正渐渐取代着原本传统、保守的治疗方式。不可否认,这些新型的手段,使人们的生命生活质量得到很大提高。然而如果过分盲目的追求、不分场合的使用这些诊疗方法,则会造成侵权行为,即本文主要阐述的过度医疗问题。2010年颁布实施的《侵权责任法》首次将过度检查纳入其中,体现了侵权责任法制定的人文情怀。但是当前环境下,过度医疗的认证依然困难重重,本文将从侵权责任的构成、举证责任以及受害人同意几个角度对过度医疗问题进行初步分析。
