严格责任与中国环境犯罪

目前我国的环境污染事故频频发生,给生态环境造成极大破坏,虽然我国政府出台了一系列法律、法规来保护环境,但司法实践中难以达到效果,所以需要从英美法系引进严格责任原则适用于司法实践来惩治和预防环境犯罪。严格责任是英美法系所特有的一项原则,对于犯罪可以有效控制。为了减弱其不良影响,严格责任在我国的适用受到严格的限制。

At the present time,environmental pollution of our country happens frequently and it destroy the ecological environment seriously.Although our government established a series of laws to protest the environment,the laws took no effect.So we have to make strict liability enforce in our legal practice to prevent and punish environmental crime.As one special principle of common law system,strict liability can control crimes effectively.To lessen its harmful influence,srict liability suffers strict limitation when enforing in our country.
