| 摘 要： | 民事诉讼目的是研究民事诉讼制度的前提和出发点。正因为如此,大陆法系国家一直比较重视民事诉讼目的的研究,并形成了诸如私权保护说、私法秩序维护说、纠纷解决说等诸多学说。笔者结合国内外关于民事诉讼目的的主要学说,提出了应当将程序保障确立为我国民事诉讼目的的观点,并从四个方面阐述了自己的理由。

| Abstract: | The purpose of the civil lawsuit is the premise and starting point of the civil lawsuit research.Therefore,the mainland legal system countries always pay attention to the research of the purpose of civil lawsuit and form many theories.The author advances the point of view that the porcedural ensure should be the purpose of our country' s civil lawsuit by elaborating the own reasons in four respects. |
