统一中国区际仲裁裁决承认与执行的条件

自港澳相继回归祖国、内地和台湾关系日渐趋暖以来,两岸四地的经济、贸易往来频繁,这给两岸四地的法律服务提出了严峻的挑战。由于政治、历史的原因,目前想要建立统一的法律制度是不可能的,表现在仲裁裁决和法院判决的承认与执行中也是一样。我们可以先通过谈判,在“一国”的基础上达成统一区际仲裁裁决承认与执行的协议,然后在其它领域达成同样的协议,最终统一中国的法律适用。

On the Conditions of Acknowledgement and Execution of Unifying Inter-district Arbitration Award

Since the return of Hong kong and Macau to mainland China and the gradual improvement of the relationship between mainland China and Taiwan,there has been an increasingly prosperous commercial exchange among the four districts on the two sides.This brings about a severe challenge in legal service in these districts. Because of the divergence in historical and political backgrounds,it is unlikely to set up a unified legal System.Difference also arises in the acknowledgement and execution of arbitration award.Therefore,negotiations are necessary before an inter-district agreement is reached on the unification of acknowledgement and execution of arbitration award and court decision on the basis of "One Country".Then,the same agreements can be achieved in other fields in order to gain the final unification in legal adaptation in China.
