| 摘 要： | 以警察职务防卫权的主体、内容及目的要素等作为分析逻辑,解析了警察职务防卫权主体的适格性、内容的法定性以及目的设定与手段对应具有高度的契合性等正当化要素,提出了警察职务防卫权行使及理论建构必须坚持职权法定、最低人权保障、依法监督与保障权力行使的三大原则。

| Abstract: | By way of discussing the subject and content of police defend rights of profession,this article analyses the reasonable elements of police defend rights of profession,that Include nature suitable subject and legal content,and the strategies should be corresponded to the purpose.This thesis puts forward three principles about exercise of police defend rights of profession,that is authority of office legal,minimum human rights ensures,and supervising according to law and legal guarantee. |
