| 摘 要： | 当前,我国网络零售业由于缺少完善的法律法规而矛盾重重。针对这种现象,首先应对各类网络零售交易网站的法律性质作出分析,理清网络零售交易的法律关系;其次建议在相关法律法规中建立"避风港"规则和网络小额争端速裁解决机制;最后建议把平台经营者制定的成熟的交易规则吸收进相关法律法规之中。

| Abstract: | At present, there are many problems because of insufficient laws and regulations in online retail sale industry. To address these problems, we should first analyze the nature of the existing laws adopted in different kinds of online retail sale websites. Second, we can set the rule of ＂ haven＂ and quick dispute settlement mechanism for small deals. Third, the mature trading rules set by online retail website owners can be wrote into related laws and regulations. |
