论企业惩戒权的完善

摘    要:企业惩戒权是内化于企业经营管理权中的一种固有权力,一方面惩戒权发挥着维护企业生产经营秩序的积极作用;另一方面,惩戒权又容易为企业所滥用,从而对劳动者的合法权益造成减损。企业惩戒权的制度设计应以劳动者义务为中心,兼及劳动法律制度的社会法属性。为保证企业实施惩戒权的合法性、有效性和合理性,必须梳理现行的有关法律,通过法律的强制性规定缩减企业自由裁量的幅度,以建立适当的企业劳动惩戒制度,实现劳资双方的利益平衡。

Abstract:The enterprise disciplinary authority is an inherent right internalized in the business management rights. On the one hand it plays an active role in protecting the production and or-der; on the other hand, it is liable to be abused by the employer, inevitably to impair the workers' rights in practice. The enterprise disciplinary authority institution should be designed with the worker obligations as the center, taking into account its attributes as the social law. To ensure the legality, effectiveness and rationality for business to implement the disciplinary authority, it's necessary to examine the present law and to reduce the amplitude of the em-ployer discretion through the mandatory provisions of the law so as to redesign the disciplinary system to balance the interests of both employers and employees.
