摘    要:2011年1月,我国台湾地区“司法院大法官会议”作出第684号解释,部分变更了之前的第382号解释,大幅拓展了大学生的救济权利.该项解释挑战了教育法学中的基础关系与经营关系二分理论,标志着特别权力关系理论在台湾高校与学生关系领域的进一步消亡.第684号解释对台湾地区的教育法学理论、司法实务和高校管理已经并将持续产生重要影响.中国大陆有必要密切关注并对其作深入分析,从而为完善现有的高校学生司法救济制度提供借鉴.

Abstract:In January 2011,the Grand Justices Council in the Judicial Yuan of Taiwan,China,issued Interpretation 684,which partially replaces Interpretation 382 and expands the cause of action for college students.This new interpretation undermines the distinction between fundamental relationship and management relationship,a legal standard previously used in education law research.With Interpretation 684,the special authority relation theory can hardly explain university-student relationship.This new interpretation has already had and will continue to have profound impact on education law theory,judicial practice and higher education administration in Taiwan.Scholars and policy makers in Mainland China should closely follow and carefully analyze these changes so as to improve the judicial remedy system available for university students in Mainland.
