| 摘 要： | 所有权类型存在两种立法模式,大陆法系国家采用不动产所有权—动产所有权模式,我国现阶段采用按生产资料所有制划分类型的模式。两种立法模式各有其产生发展的历史背景与自身特征。中国应采用不动产所有权—动产所有权模式构建所有权制度体系。

| Abstract: | There are two kinds of legislative structures for the type of ownership.The Civil Law uses the “real estate ownership—movable property” legislative structure, and China uses “state ownership—collective ownership—personal ownership” structure. The two kinds of legislative structures have their own history and features respectively .China should choose “real estate ownership—movable property” legislative structure. |
