论行政信赖保护原则

行政信赖保护的理论研究和法制化建设在我国刚刚起步，在行政立法和执法中没有贯穿信赖保护原则这样一个核心思想，与此相关的制度也极不完善。市场经济的发展，建设中国诚信体系的现实需要以及民主与法治建设的推进等对建立和完善我国信赖保护原则及相关制度提出了迫切要求。要借《中华人民共和国行政许可法》颁布和实施的契机，加强信赖保护的理论研究，树立政府诚信的观念，进一步进行信赖保护的制度建设，推进以信为本，以人为本的行政法治目标早日实现。

Administrative trust protected principle was first proposed by administrative law scholars from continental law countries like Germany, then acceptedby legislation, and now it have already become an important principle of the administrative law in the relative countries. In recent years, this principle is paid more and more attention to in our country's administrative law,the preliminary development has already been obtained in the relevant research,and the principle have already entered into the legislation. however,the studied in the field and the legal construction in China is still on her first step,and this key thought has not been run through in the administrative legislation and enforcement, the relevant systems is not perfect extremely either. Development of market e-conomy, the realistic need in building China sincere system, as well as the advancement of democracy and legal construction call for perfection of the principle. We should grasp the chance of the legislation and enforcement of the administrative permition, set up the concept of the sincere government, construct the further protection system, move forward the early realization of the administrative legal goal, honesty first, and people first.
