| 摘 要： | 通过对采矿权法律定位各种不同意见的分析，结合权利本身的法律属性，明确肯定物权法对采矿权的法律定位——用益物权，同时进一步提出细化建议，分离采矿权中其它类型权利，改革权证混杂不清的现状，以保障采矿权的法律定位能促进权利效能的实现。

| Abstract: | Through the analysis of the mining right legal position different opinions, the legal attribute of com- bining rights itself, clear affirmation for mining right is the legal position of property law, and further puts for- ward detailed Suggestions, separation of other types of rights of mining right, supplemented by the operation- al rules of form a complete set, in order to protect the rights of mining right legal position can promote effi- ciency of the implementation. |
