| 摘 要： | 诉辩交易制度是美国的一项刑事诉讼特别程序,该制度的存在有其一定的司法价值基础和合理性.我国一些刑事法律制度及刑事政策同样蕴涵着诉辩交易的精神.完善中国式诉辩交易制度,应当在借鉴国外合理做法的基础上,通过立法进行必要的规制.

| Abstract: | The plea bargain system that contains worth of judicial process foundation and rationality is the special procedure of the United States in criminal procedure. The law system and policy in crime of our nation includes the spirit of the plea bargain. In order to perfect the bargain system, we should draw lessons from foreign countries in their ways and make law to rule them. |
