摘    要:法律体系的构成要素是制定法,人才流动法律体系的形成及演变是由其要素的变动来反映的。对人才流动的法律规范的研究是认识和分析法律体系的基础。我国目前关于人才流动的法律规范位阶较低,系统性、协调性差,规范的刚性不足,人才权益的救济程序设计不合理,尚未形成涵盖人才及人才流动关系整体的相对完整的规范体系。

Abstract:The key elements of the law system is the law enactment, the formation and involutionofthe legal system of equitable mobility of science and technology talents is reflected by the change of the key elements. To research and the legal system of equitable mobility of talents is the base to learning and analysis the law system.the legal system of equitable mobility of talents in our country is in a low phase, not very systemic and eurhythmic.,and weak in constraint.,The protect program of the talents right is not very complete and equitable, there is still not a relative complete systemcovering the talents and the mobility of the talents.
