| 摘 要： | 以中国民法文化为论说对象,通过讨论造成民法文化传统虚位的自然条件、制度观念、思想意识三大原因,举例分析现代民法文化中微观制度价值基础、中观所有权主体结构、宏观公私法文化辨析三个层次的定位,提出以传统为本位,学习外国先进私法文化,结合本土实情,建构中国现代民法文化的基本观点。

| Abstract: | This article aims to research the culture of China's civil law.Firstly it discusses the natural conditions,institutional idea and ideology that make traditional culture of civil law absent.Then the writer analyses by example the position of micro value foundation,medium structure of subject of ownership and macro culture of public law and private law in modem culture of civil law.Finally it tries to draw a conclusion that we should take tradition for foundation,integrate conditions of our country,study western advanced jurisprudence,and construct China modem culture of civil law. |
