论虚假新闻的违约与侵权责任

新闻首要的基本属性是真实性。真实性是新闻的生命,是新闻事业持续、健康发展的重要前提。虚假新闻是对新闻真实性的背离,媒体对受众提供虚假新闻既可以构成违约,也可以构成侵权。如果新闻媒体提供给受众的是虚假新闻,并且此虚假新闻是新闻媒体自己杜撰的,则新闻媒体既是构成侵权责任的主体,也是构成违约责任的主体;如果虚假新闻的提供者是政府机关或自由撰稿人,则新闻媒体因过失导致虚假新闻的传播,新闻媒体应承担违约责任,政府或自由撰稿人则承担侵权责任。

On the Breaking Treaty and the Tort Right of the False News

The first basic nature of news is truth. The truth is the life of news, the important premise for the sustained and health development of the news course. The false news is departing from the truly news. It can construct the deed of breaking treaty and tort for the medium to accept the false news given by the masses. If what the news medium gives the readers is the false news and this news is fabricated by the medium itself, then this medium is the main body of the tort right, as well as the one that breaks treaty. If the provider is the government organ or the free writer, then the news medium should bear the duty for breaking treaty because of its wrongly disseminating the false news and the government or the free writer should bear the duty of tort right.
