环境法的终极价值之思考

环境法若有一个确定的终极价值为指导，其发展将会更加快速、有效和理智。环境法的终极价值是对人的尊重，表达了对个人、组织、国家以及全人类的生存、发展等各方面权利的完善和发展的意愿，应加强环境行政部门和环保组织的地位和作用。对人的尊重与可持续发展的关系，两者本质上是一致的。此外，比较对人的尊重与人类中心主义的关系，认为两者是两种不同的价值观，并批判了人类中心主义。

Considerations about the Ultimate Value of the Law of Environment

If there is an ultimate value as guidance in the law of environment, the development of the law of environment will be faster, more effective and more rational. This article holds that the ultimate value of the law of environment is respecting humans, and makes a detailed analysis of the conotation of this ultimate value. Meanwhile, the article expresses the aspiration for perfecting and developing rights of survival and development of mankind as well as those of individual persons, organizations and nations. It also considers it necessary to strenghthen the status and function of the departments of environmental administration and the organizations of environmental protection. The article believes that both respects for humans and sustainable development are consistent in essence. Furthermore, the article makes a comparison between respects for humans and antropocentrism. Based on this, the author concludes that both are different views of value and criticizes antropocentrism.
