| 摘 要： | 质权是一种重要的担保物权 ,当铺收取当户的当物所设定的权利就是一种典型的质权。中国古代当铺制度相当发达 ,运用质权法的理论 ,历史地分析中国古代当铺的质权 ,对制定有关现代当铺的法律 ,具有一定的参考意义。

| Abstract: | Mortgaqe is an important form of secured property rights.The pausnshop's mortgage of chorging the mortgagor's proprty is a typical one.In ancient china,the mortgaging system was quite advanced.This paper analyses historically from the perspective of the mortgage law the pawn shop mortgage in ancient china This ancient mortgage provides some reference for the making of laws of the modern pawnshop. |
