论主权运用的实效性法理评判

主权的实际运用是复杂而多样的,因而也产生了许多影响、挑战主权的现象,例如主权的让渡、共享以及受到越来越多的限制和约束。在厘清主权的两个维度的属性、内涵的基础上,应当避免采用抽象思辨性的路径来分析把握这些主权运用上的矛盾现象,转而采用一种实效性的法理评判路径,即是否适应和满足于国际、国内社会身份秩序和整体演化发展的需要,以及国家、民族的自身根本利益要求。并根据当前国际社会的现状、特点,引入国家能力标准等予以进一步的分析、确定。
