| 摘 要： | 知识产权保护的目的本来在于保护创新和促进社会财富的增加,但对知识产权的过度保护却越来越成为合法垄断的工具。利用反垄断法,可以有效地规制知识产权滥用的行为,有利于企业公平竞争,获得经济效益,促进经济增长和社会发展。

| Abstract: | It is the purpose to protect innovation and accelerate increasing wealth for intellectual property rights,but over-protection of intellectual property rights is the tool of legal monopoly.By using antimonopoly law,the abuse of dominant in the market and intellectual property rights in the enterprise consolidation can be controlled. |
