| 摘 要： | 机动车交通事故损害赔偿适用无过错责任原则历来存在争议。拟从无过错责任原则产生的背景、内涵及特征出发,论述交通事故适用无过错责任原则的法理基础,分析交通事故适用无过错责任原则的现实价值,指出《交通安全法》第76条有关无过错责任原则的规定有利于我国法律秩序的统一、保障人权事业的发展和促进社会的和谐。

| Abstract: | The paper analyzes the significance of application of principle of liability without fault in the traffic accident while discussing the backgrounds of principle of liability without fault and its connotation and features.The paper points out that the provision of principle of liability without fault in the Traffic Safety Law of PRC facilitates the unity of legal order and the harmonious development of society. |
