| 摘 要： | 婚约制度是世界法律文化的重要组成部分。建构我国现代婚约制度的价值是多方面的。它是解决现实订婚纠纷诉求的法律救济途径,并权威性的确认男女双方身份关系的真实变化,同时有利于妇女合法权益的制度性保障和男女双方正确理性地对待婚姻,也是法回归社会实现其正义价值的有效路径。

| Abstract: | The promise system of marriage is the momentous part of the World Legal Culture.The value of establishing the promise modern legal system of marriage in our country embodies some aspects.It is a legal remedy to solving disputes in promises of marriage,authoritatively confirms the authentic change of identities of the man and woman,also it is propitious for systematic safeguard legal rights of women and they rationally treat marriage,and it is the available method of fulfillment justice by the way of law coming back society.So we must positively establish the promise modern legal system of marriage. |
