| 摘 要： | 我国继承法对遗嘱继承方式作出了明确和严格的规定，但没有规定共同遗嘱，由此在实际操作中常常存在争议，通过对共同遗嘱的研究和探讨，能够从学理上解惑，从法律上定位，并为实践操作提供导向。

| Abstract: | In Chinese law of inheritance there are strict and clear regulations about the inheritance by will. But the law doesn' t mention the regulations about the co-will. Consequently the disputes concerning co-will always happened in judicial practice. Therefore, it is necessary to study and explore this issue, and provide theoretic reasons and law guidance for the judicial practice. |
