| 摘 要： | 把“为他人谋取利益”作为收受型受贿罪的要件，符合我国现在的国情。“为他人谋取利益”是收受型受贿罪的客观要件，但不以已着手实行为限，还包含“为他人谋取利益’’的作准备的行为；是否“为他人谋取利益”不影响受贿罪既遂的成立。

| Abstract: | It is fit for Chinese situation to take seeking profit for another as one constitution of the crime of accepting bribes. Seeking profit for another is the objective constitution of the crime of accepting bribes; which not only comprise the act of starting to commit a crime, but also comprise the act of preparing for committing a crime. Whether seeking profit for another or not, it doesn't affect the establishment of accomplished offense. |
