信用证欺诈例外制度研究

信用证的独立性原则是信用证的两大基本原则之一,它对于信用证制度的生存和发展起着至关重要的作用。然而,实践中产生的信用证欺诈对该原则提出了严重的挑战,并进而导致了欺诈例外原则的产生。本文主要就该欺诈例外原则的产生、理论依据及其适用进行深入地分析和研究,并对我国有关的立法和司法现状作出评价和展望。

On Fraud Exception to the Independence Principle of the Letter of Credit

The independence principle is one of the two basic principles of letter of credit,and it contributes greatly to the development of letter of credit system. However, frequently occurred fraud in letter of credit transaction raises a big challenge to the independence principle, and finally gives rise to the coming into being of the principle of fraud exception. This paper first makes a thorough study on the fraud exception principle, then makes a comment on the present situation of letter of credit legislation and judicial practice in China, followed by some proposals.
