中国战时抗命罪的历史沿革

在中国军法漫长的发展演变过程中,战时抗命罪亦在浩瀚如海的历史画卷中,不断发展,不断变幻,成为解读军法变革轨迹与节点的线索。审慎研究战时抗命罪的历史沿革,对萃取中国军法的精神——法价值,以及检讨法规范符应法价值的程度,并以此为引,改良完善当前军法,尤其是战时军法,具有一定的理论价值与实践意义。笔者怀着通过一种纵向梳理以探求战时抗命罪精髓实质的希冀,按照古代至近代再到当代的顺序,依次对我国战时抗命罪进行观察、探讨,通过对不同历史阶段法规范所设计的战时抗命罪加以比较,分析其间的异同,进而引入法价值的考量要素,对战时抗命罪所蕴含的内在精神提出了一管短见。

Historical Evolution of the Crime of Disobeying Command in the Time of War in China

In the course of the far-flung development of the Chinese military law,the crime of disobeying command in the time of war continually develops and transforms as well,and becomes the key for unscrambling the track and node of the evolution of Chinese military law.It is theoretically valuable and of practical meaning that well-advised researching the historical evolution of the crime of disobeying command in wartime,especially for extracting the spirit of Chinese military law,namely verifying the degree of an accord between juristic value and regulation,and by right of that to improve current military law,in particular,the law in the time of war.The author analyzes the crime of disobeying command in different epochs according to a historical order and brings forward personal opinion on the inherent spirit of the crime by construing similarities and differences of all kinds of the crimes in Chinese history,in which juristic value is the foremost criterion with a sort of lengthways historical carding.
