| 摘 要： | 在保安处分制度日益为各国刑法普遍接受的今天，我国刑法典对保安处分制度仍保持少有的沉默，而现有的保安性措施也存在其固有的弊端。文章从保安处分的起源出发，阐述了西方近现代保安处分制度的改革发展及其现行法规定，揭示了保安处分制度在中国适用的必要性与可行性，并提出了一些合理性建议。

| Abstract: | Nowadays security measures system has been accepted more and more widely in many countries. While China keeps silent on its criminal laws about the system, and its security measures have their own advantages. This paper, from the origin of security measures, expounds the reforms and development of the system in modern west and the current statutes, reveals the necessity and feasibility of the system in China, and it also gives any reasonable suggestion. |
