从法律与道德的关系看中国信用立法

法律来源于道德并反映道德的要求。社会中的道德分为基本道德和非基本道德,只有基本道德才需要制定为法律以国家的强制力使社会成员得以遵守,人类经济生活中的诚实信用正是社会生活中的基本道德。已有法律制度的不足和信息化发展的要求使现代信用法律制度的诞生成为必然。中国社会当前的信用危机除了缺乏现代信用法律制度之外还有更为复杂的背景,尽快制定全国性的信用立法是中国社会主义市场经济的现实要求。

Looking for the Legislation of Credit in China from the Relation between Law and Morals

Law stems from morals and reflects the need of them.Morals are divided into basic morals and non-basic morals,only the basic morals ought to be translated into law and make the masses obey.Credit is the basic morals.It makes the birth of modem credit system an inevitable trend that the inadequacy of law that safe- guarding credit and the development of information.There have been more complicated reasons except for the in- adequacy of modern credit system that coming into the crisis of credit in China.It is an urgent need that making laws of credit in China which applying to the whole nation.
