| 摘 要： | 《合同法》及其司法解释将代位权的客体限定在“具有金钱给付内容的到期债权”。目前。我国法律规定的代位权客体范围过于狭窄，非合同债权、债的从属性权利、合同上与诉讼上的权利、债务人享有的代位权和撤销权与抵销权、保存债务人权利的行为等应成为债权人行使代位权的客体；同时债权人行使代位权的范围是“债权人自己的债权”，且代位权具有优先受偿性。代位权的优先受偿性是债权人以“自己的债权”行使代位权的逻辑前提和实践动力。

| Abstract: | Contract Law, as well as its juristic interpretation limits the object subrogation right as ones mature right with the content of payment. In terms of comparison, the object subrogation fight is over limited and thus needs to be extended. On the basis of Contract Law and its juristic interpretation, and of complying with the premise of legislative spirit, this article discusses and states some viewpoints on the extension of the object subrogation right. What＇s more, this article give an idea that the range of subrogation right is ＂one＇s own creditor＇s rights＂. The subrogation right has the priority of being paid off. The priority of being paid off is the logic premise and carries out driving force for the creditor to exercise subrogation right with ＂one＇s own creditor＇s rights＂. |
